WASHINGTON, D.C.– American Library Association (ALA) President Roberta Stevens released the following statement today regarding President Obama’s 2012 budget request:

The president’s budget proposal strips funding away from one of our greatest resources for lifelong learning – our libraries. Libraries are fundamental to meeting the reading and information needs of communities nationwide. During this difficult recession, they rose to the challenge of helping Americans get back to work through vital assistance with online job searches and applications as well as resume development. In addition, many libraries hold classes to teach the critical 21st century digital literacy skills that are essential to thriving in today’s global economy.

Libraries are being used by millions of people every day. When we invest in them, we invest in the future of our country. We ask Congress to restore the support for America’s libraries.”

The president’s budget requested $194 million for assistance to libraries to be administered by the Institute of Museum and Libraries Services (IMLS). This request is approximately $20 million below the current funding level.

Like last year, the president chose to consolidate the Improving Literacy Through School Libraries program with several other literacy programs.

Identity theft; Red Flags rule

I’ve had a couple questions recently related to “required training for staff on the Red Flags Rule” related to protecting accounts from identity theft. Please see the information pasted below. I really don’t think the training is necessary for library or government personnel (unless for some reason you access credit accounts, report to credit bureaus, or make loans)

· What if I work for a municipality, city, or county, and we've already determined our activities fall within the Rule's definition of "creditor" or "financial institution"? Do our taxes, fines, etc., become "covered accounts" under the Red Flags Rule?

No. These fees are not covered accounts under the Rule because a person is not establishing a relationship to get goods or services.

· Does the FTC have a sample training policy for employees?

No. That wouldn't be practical because each Program is unique. Your employee training policies should be based on the specific red flags you've identified in your business or organization and the procedures you've put in place for detecting and responding to those red flags.

Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

This Act may be cited as the ‘‘Red Flag Program Clarification Act of 2010’’.

SEC. 2. SCOPE OF CERTAIN CREDITOR REQUIREMENTS.

(a) AMENDMENT TO FCRA.—Section 615(e) of the Fair Credit Reporting Act (15 U.S.C. 1681m(e)) is amended by adding at the end the following:

‘‘(4) DEFINITIONS.—As used in this subsection, the term ‘creditor’—

‘‘(A) means a creditor, as defined in section 702 of the Equal Credit Opportunity Act (15 U.S.C. 1691a), that regularly and in the ordinary course of business—

‘‘(i) obtains or uses consumer reports, directly or indirectly, in connection with a credit transaction;

‘‘(ii) furnishes information to consumer reporting agencies, as described in section 623, in connection with a credit transaction; or

‘‘(iii) advances funds to or on behalf of a person, based on an obligation of the person to repay the funds or repayable from specific property pledged by or on behalf of the person;

‘‘(B) does not include a creditor described in subparagraph (A)(iii) that advances funds on behalf of a person for expenses incidental to a service provided by the creditor to that person; and

‘‘(C) includes any other type of creditor, as defined in that section 702, as the agency described in paragraph (1) having authority over that creditor may determine appropriate by rule promulgated by that agency, based on a determination that such creditor offers or maintains accounts that are subject to a reasonably foreseeable risk of identity theft.’’.

I’m still not a lawyer but it does not seem that most libraries or agencies that do not regularly use or report to credit reporting agencies are in any way impacted by the law. I would expect those libraries dealing with recovery agencies (like Unique that do regularly report to credit agencies) would be hearing from those agencies to tighten the information they are provided.

In this one hour session, we'll demonstrate just how easy searching EBSCO resources can be. Easy to navigate, this database is designed to promote an overall understanding of health-related topics. TexShare provides you with over 30 full-text databases that are available via the EBSCOhost interface. These resources include publications and information concerning business & careers, health, government, history, technology, current events and our very own Texas Reference Center! This session will serve as an introduction to the different search modes, how to refine results using the Narrow By limiters, as well as citing, printing, emailing and saving results.

Advanced Search Strategies and Tools using EBSCOhost provided through TexShare (EBSCOhost)
This session is designed for those who want to get the most of the EBSCO search experience. We'll explore advanced search strategies, use guided style search boxes and field codes and learn how to use limiters for detailed searching. We'll access publications and create journal and search alerts. Users will learn how personal folders can benefit both staff and patrons/students. Finally, we'll review EBSCO's Support Site for training and marketing resources and tools to promote these valuable resources provided through TexShare.

Explore the Library Development Division's blog for Grant Opportunity postings. Start with this recent post from Jennifer Peters then explore links to previous featured opportunities listed below the current post. Visit the grants lists on the Houston Area Library System website. Register for TSLAC's grants listserv.

In addition to advertised grant opportunities libraries are reporting success obtaining funds from: their local banks; railroads; electric utility; retailers; and service clubs. In some cases the local entity has funds to distribute; frequently their parent organization also provides funding from a foundation.

TexShare Update - Email addresses removed to limit spam

Dear TexShare Member Libraries:

We’ve heard from a number of libraries regarding H.B. 1 and TexShare funding. All of the TexShare and Texas State Library and Archives Commission (TSLAC) staff are working hard to address your concerns and reflect our commitment to providing the library community with access to the databases they value most.

· We have funding in place this year to renew the core set of TexShare databases (www.tsl.state.tx.us/texshare/licenseagreementsfy2011.html) through June 30, 2012. The Electronic Information Working Group (EIWG) will meet soon to determine whether we should streamline this core in order to “shore up” our resources for deployment in the next biennium. Please feel free to contact TSLAC (russlene.waukechon@tsl.state.tx.us) or any member of the working group (http://www.tsl.state.tx.us/texshare/databaseworking.html) to discuss your priorities for the database program.

· Our calculations indicate that we will be able to provide a solid core of databases through the next biennium – with subscriptions running through June 30, 2014.

· Member fees will be increased only to a level that is affordable to member libraries and reflects a significant cost savings to them. The Database Cost Sharing Working Group will meet in early February. Please contact TSLAC , Ann Mason, or any member of the working group (http://www.tsl.state.tx.us/texshare/costsharingworking.html) to discuss your concerns regarding cost share.

· TSLAC has submitted a request to the Legislative Budget Board to add state (general revenue) funding of $3.3 million over the biennium to the TexShare database program. This is ranked as the commission’s highest priority. A state funding base for TexShare is vital to the long-term sustainability of the database program. If you are interested in supporting this request or in communicating with the Legislature, the Texas Library Association has resources that can assist you. (www.txla.org)

· We have also received questions regarding the courier service. We are working on funding scenarios for that service. As the situation unfolds, we’ll keep you informed.

· We look forward to continuing our support for the TexShare card program, to which we are fully committed.
